More signs of a return to the rule of law under Obama.

Talking Points Memo has just reported an Associated Press “breaking” story that a draft executive order has been readied for Obama that will close down Guantanamo Bay prison within 1 year. This of course would be good news if true, but we still need to see what Obama intends to do with the now suspended military commission show-trials.

That latter maneuver, by the way, removes the excuse reason Harper keeps using for not repatriating Khadr. You know, about the fact there is a “process” ongoing? Well, the process has been suspended. It would be good political capital for Harper to spend with the new Obama administration by repatriating Khadr. If there is evidence to try him, do so in a Canadian court. As well, start the process of rehabilitating him as a child soldier, as spelled out by the UN protocols.

Otherwise, Harper and his ministers should just spit out the real reason they don’t want him back ; I think it’s because they’re afraid he’ll be found innocent of the charges, or that evidence was tainted by use of torture, or that the kid was brainwashed into fighting and would probably be ordered free by a traditional court of justice. Any of those results would rile the “throw-away the key, screw his rights” supporters of the Conservatives on the whacko rightwing.

On another note, and speaking of the right wing whackos, has anyone seen Ezra or Kate or others over there issue any retractions over calling Maher Arar a liar or a terrorist over some rather overstated claims that Khadr said so, which was shown to be overstated by the Calgary Herald of all papers? I don’t expect it from them, quite frankly; they havent showed any prior inclination to apologize for smears they make. It would probably take a letter or 2 from Arars’ lawyers to them, and I know for a fact that a few people sent their rantings to Maher Arar (and presumably his lawyers), so I’ll be watching that with some interest.

The Obama administration is circulating a draft executive order that calls for closing the detention center at Guantanamo Bay within a year. The draft order also would declare a halt to all trials currently under way at the facility, where roughly 800 detainees in the war on terror are held…Word of the draft order comes on the same day that a judge granted Obama’s request to suspend the war crimes trial of a young Canadian in what may be the beginning of the end for the Bush administration’s system of trying alleged terrorists.

    Obama has to figure out what to do with the detainees. Sending them all back to their country of origin will results in Arar type treatment. They were well treated at Gitmo, Micheal Moore even admits such in “Sicko”.
