Conservatives trying to avoid another Maher Arar payout

You might remember Abousfian Abdelrazik, a Canadian citizen who was detained in Sudan on terrorism suspicions, who was then released by the Sudanese when they could find no basis for the charge. The Harper government then tried to keep him out of Canada, claiming he was dangerous (but doing so while they allowed him to take refuge in the Canadian Embassy). A judge would have none of it, and forced the government to allow him to return home. Mr. Abdelrazik understandably decided to sue the government – in this case, 27 million $ for his (mis)treatment. There’s a column in the Star today from Professor Errol Mendes, who teaches constitutional and international law at the University of Ottawa, on the background of the Omar Khadr case as it has wound through the Canadian courts. There is also an observation or 2 from Professor Mendes about Stephen Harper being offside with the court decisions, and he lists a reason about why he thinks Harper continues to oppose asking for repatriation, and why he potentially will appeal the latest 2-1 Federal Appeals Court ruling against him ordering him to ask for Omar Khadr’s repatriation to the Supreme Court of Canada:

After reading this bit of horror, I think Abousfian Abdelrazik has as good a case as Maher Arar did to sue the Canadian government for the way they refused to help him and how they treated him. I’d love to hear Deepak Obhrai explain right about now why he couldn’t even look the guy in the eye to tell him he couldn’t come back to Canada.

This is a pretty cool blogpost that has a couple of pretty cool pictures there with the Doctor and the recently returned home Abousfian Abdelrazik (who can thank the Federal Court for his return home, and not to our disgrace of a government, who wouldnt even allow him to fly to Montreal from Toronto once he got home).

The only thing I’d ask Dawg is if he noticed any dark cars outside his house and/or any folks in dark suits with binoculars. Actually, I’ll ask another question; any indication that Abousfian is going to be suing the government a la Maher Arar for his mistreatment? He certainly has a [...]

No surprise here for me about this decision by the Conservatives; they’re obviously going to go to the bitter (judicial) end to avoid any real action on Omar Khadr unless the Supreme Court forces them, or Obama beats them to the punch: (read more) [...]

I’ve said before that I thought Abousfian Abdelrazik would have a stronger case before the Federal Court on being allowed back into Canada then Omar Khadr (and note that Omar did win his case – at least in the Federal Court), simply because of all the promises given to him by the government and then taken away, as well as the statements by our intelligence agencies he poses no threat to Canada. The UN also seems to have gotten tired of the Canadian government using it as a crutch for trying to justify keeping Abdelrazik out of Canada, as a UN official in charge of the blacklist program came [...]
